Terms of Service

The terms that govern your use of NativePen, the macOS writing assistant and its website account.

These Terms of Service ("Terms") govern your use of NativePen, including the NativePen macOS app, the website at https://nativepen.app and your NativePen account (together, the "Service"). The Service is operated by NativePen ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

NativePen is a macOS menu-bar app that works with a website account. When you select text and choose an action (for example translate, polish or draft), the app sends the selected text and your instruction to our server. Our server forwards them to third-party AI model providers through OpenRouter and returns the result to the app. Each of these is a "request".

2. Accounts

You must be at least 13 years old, and old enough to agree to these Terms where you live. If you are under 18, you need permission from a parent or guardian. You can sign in with Google, GitHub or email. You are responsible for keeping your sign-in methods secure and for all activity under your account, including requests made from any Mac you have authorized. Provide accurate information and keep it up to date.

3. Credits and packs

  • The Service uses credits. Each request costs 1 credit and can include up to 4,000 characters of text.
  • New accounts receive 50 free credits on sign-up.
  • You can buy additional credits as one-time packs. Packs are not subscriptions and do not renew automatically.
  • Credits from a purchased pack are valid for 30 days from the date of purchase. Unused credits expire at the end of that period.
  • Credits are not transferable between accounts and cannot be exchanged for cash.
  • If a request fails on our side, the credit for it is returned to your balance automatically.
  • Prices are shown on the pricing page at the time of purchase and may change for future purchases.

Refunds are handled under the Refund Policy.

4. Payments

Payments are processed by our payment processors. We never see or store your full card number. Your purchase may also be subject to the payment processor's own terms. Any taxes are shown at checkout where they apply.

5. Your content

You keep ownership of the text you submit and of the outputs generated for you, to the extent permitted by law. You give us a limited permission to process that text only as needed to provide the Service, which includes sending it to AI model providers. We do not store the text you submit by default. You are responsible for having the right to submit any text you send through the Service.

6. Acceptable use

You must follow the Acceptable Use Policy. We may suspend or close accounts that violate it. In that case unused credits may be forfeited.

7. AI output

Outputs are generated automatically by AI models and may be inaccurate, incomplete or unsuitable for your purpose. Review every output before you rely on it or send it to anyone. The models we offer may change over time.

8. Third-party providers

Parts of the Service depend on third parties, including AI model providers, OpenRouter, hosting providers and payment processors. Their availability is outside our control, and the Service may be interrupted when they are unavailable.

9. Intellectual property

The NativePen app, website, name and logo belong to us. These Terms do not give you any right to them except to use the Service as described here. Do not copy, reverse engineer or resell the Service.

If you believe content handled through the Service infringes your copyright, email support@nativepen.app with a description of the work, where the infringing material appears, your contact details, and a statement that you have a good-faith belief the use is not authorized. We will review the notice and act on it where appropriate.

11. Termination

You can stop using the Service and delete your account at any time by emailing support. We may suspend or end your access if you break these Terms or if we stop offering the Service. If we stop offering the Service for reasons other than your breach, we will refund unused credits from packs that are still valid.

12. Disclaimer and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.

13. Changes

We may update these Terms. We will announce material changes on the site or by email at least 14 days before they take effect. If you keep using the Service after that, you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict of law rules. This does not take away any mandatory protections of the law of the country where you live.
